These Terms and Conditions constitute a legally binding agreement between the "Comfy Platform" and the "User". The following words and phrases shall have the meanings set forth opposite each of them unless the context requires otherwise:

• Platform: Includes the Comfy website, mobile applications, and any application programming interfaces affiliated with it.
• Suppliers (rental companies): Licensed external entities (car rental companies, driver service providers, insurance companies) that offer their services through the Platform.
• User: Every natural or legal person who benefits from the Platform's services.
• Services: The technology-enabled facilitation and intermediation between the User and rental companies for the purpose of completing bookings.

• You possess full legal capacity to enter into binding agreements.
• If you use the services on behalf of a company or organization, you are legally authorized to bind such entity to these Terms.

With respect to beneficiaries and people authorized to drive the vehicle:

• They have a valid official identity document.
• They have a valid driving license throughout the term of the contract (and its validity shall not be less than 6 months from the contract date).
• The insurance coverage conditions stipulated in the vehicle insurance policy apply to them.

The Platform has the right to suspend or reject any account or booking if it suspects a violation of these Terms or the applicable regulations.

To benefit from some features of the Platform, an account must be created. By creating an account, you agree to:

• Provide accurate, complete, and up-to-date information.
• Maintain the confidentiality of login credentials.
• Notify the Platform immediately upon suspecting any unauthorized use of your account.
• Your account is personal and may not be shared under any circumstances.
• You alone are responsible for all activities carried out through your account.

Comfy shall not be liable for any losses or damages resulting from unauthorized access to your account.

The Comfy Platform operates as an electronic intermediary connecting users with licensed suppliers to provide services of:

• Vehicle rental
• Drivers
• Insurance
• Related additional services

The Platform is not deemed a direct party to rental contracts or services provided by rental companies; rather, its responsibility is limited to facilitating booking, payment, and the electronic services associated therewith.

Accordingly, the User acknowledges and agrees that rental, driving, and insurance services are provided by independent licensed rental companies, and that the Platform's role is limited to technical and administrative facilitation. In no event shall this result in the creation of any partnership, agency, employment, or representation relationship between the Platform and any rental company. The rental company alone shall bear responsibility for implementing the services, their quality, and compliance with the regulations, licenses, and statutory requirements applicable to the activity or service.

When making any booking through the Platform, the User agrees to the following:

• All bookings are subject to actual availability with the rental company, and the Platform makes no undertaking or warranty, whether express or implied, regarding the availability of any vehicle or service at any time, as this remains exclusively subject to the supplier's availability and the operational considerations prevailing at the time of request or execution.
• The User undertakes to pay the full booking value and due fees in accordance with the prices and policies approved at the time of booking.
• The booking shall not be deemed confirmed or effective unless a confirmation notice is issued by the Platform.
• The Platform or the rental company has the right to reject or cancel any booking where there are statutory, operational, security, or technical reasons, or where misuse of the service or violation of the Terms and Conditions is suspected.
• Some bookings or services may be subject to additional terms specific to the rental company, and the User is obligated to review and agree to them when available in order to complete the booking or use the service.
• Comfy's responsibility shall not extend to any restrictions or requirements that may be imposed by the rental company to execute the booking, and the User is required to comply with them in order to complete the booking (such as a refundable security deposit, age requirement, etc.).

• All payment transactions are made through the payment methods approved on the Platform.
• The displayed prices include Platform-specific service fees, profit margins, or operational fees that are disclosed to the User upon payment or before booking confirmation.
• The User shall bear all applicable taxes and government fees, including value-added tax or any other statutory fees in accordance with the applicable regulations.
• All displayed prices are subject to update or modification at any time before booking confirmation, and no previous unconfirmed price shall be relied upon.
• The User hereby authorizes the Platform and the rental company, to the extent necessary to implement this Agreement, to deduct any amounts due, compensation, violations, fines, or additional fees arising from the use of the service, including traffic violations, damages, late fees, or any financial obligations resulting from the use, from the payment method registered by the User and in accordance with the applicable regulations and policies.
• The User acknowledges that the Platform may retain pending amounts, verify the validity of the payment method, or place a temporary hold on certain amounts when needed for operational, security, or financial purposes related to the booking or service.

• The User has the right to cancel the booking before the pickup time in accordance with the specified policies.
• In the event of cancellation more than 24 hours before the booking time, the User has the right to a full refund.
• In the event of cancellation less than 24 hours before, the value of the first day's rental shall be deducted.
• The processing period for refunded amounts varies depending on the bank or payment service provider.
• The Platform has the right to reject refund requests in the event of misuse or violation of the Terms.
• All refund transactions are carried out through the technical means of the Platform.

• All vehicles are subject to the terms and conditions of the insurance policies approved by the rental company, and the User acknowledges that insurance coverage, its limits, and exclusions are subject to the terms of the insurance policy applicable to the vehicle.
• The User shall bear any deductible amounts, damages, or amounts not covered by insurance coverage, in accordance with the applicable insurance policy and relevant regulations.

To benefit from any insurance coverage or additional insurance, the following is required:

• Submission of an official report issued by the competent authority at the time of the accident. The User shall not have any right to insurance coverage or to benefit from additional insurance except upon submission of such report and in accordance with the terms and conditions stated in the relevant insurance policy.
• The User and the vehicle driver shall comply with traffic regulations and applicable instructions.
• The vehicle driver must be legally authorized and permitted to use the vehicle in accordance with the contract and approved terms.

Insurance coverage does not include — unless the insurance policy provides otherwise — cases resulting from:

• Using the vehicle in a manner contrary to the law, the contract, or the nature of the authorized use.
• Enabling a person who is not authorized or legally licensed to drive the vehicle.
• Any intentional misuse or gross negligence that results in damage, loss, or violation of applicable laws, regulations, or contractual obligations.

The Platform shall not bear any responsibility for accepting or rejecting insurance claims or for the scope of insurance coverage, as this is subject to the insurance policy concluded between the supplier and the insurer.

The Comfy Platform generates its revenues through commissions, profit margins, or service fees associated with bookings or services provided through the Platform, while committing to disclose to the User the material fees associated with the booking or service.

The User undertakes to do the following:

• Comply with all traffic laws, regulations, and instructions applicable in the Kingdom of Saudi Arabia.
• Use the vehicle lawfully and personally and not enable any person who is not legally authorized to drive or use it.
• Preserve the vehicle, use it with care, and not use it in a manner contrary to the regulations, the contract, or the nature of its designated use.
• Return the vehicle at the specified time and place and in the same condition in which it was received, taking into account normal wear and tear resulting from ordinary use.
• Comply with all provisions stipulated for the User and included in any clause of this Agreement.
• Respect the rights and privacy of other users and third parties and not misuse the Platform or services in any form whatsoever.

The Platform may, at its discretion, suspend the account, restrict the services, or terminate them upon violation of any of the obligations stated in this Agreement.

The User is prohibited from performing any of the following acts:

• Using the Platform and services in an unlawful or non-compliant manner.
• Misusing the Platform or services.
• Providing misleading or incorrect information.
• Using the Platform for any fraudulent or illegal purposes.

The Platform has the right to take appropriate measures, including suspending or disabling the account or taking legal action.

The supplier company that owns the vehicle has the right, in the event of late payment, the existence of a serious suspicion of misuse, or proof of violation of the contract or applicable regulations, to take such statutory and precautionary measures as it deems necessary to protect its rights and recover the vehicle, including the use of technical tracking means, submission of official reports, and taking field or judicial recovery procedures, all in accordance with the applicable laws, regulations, and instructions, without prejudice to any other rights, claims, or compensation established for it by law or contract.

The User also acknowledges and agrees that the supplier may take the operational or technical measures necessary to verify the condition or location of the vehicle or to recover it where there is a statutory or contractual justification for doing so, provided that this does not violate the applicable regulations.

The Platform may offer loyalty programs, offers, discounts, or promotional vouchers. Such programs shall be subject to the following:

• They may be modified or discontinued at any time.
• They are not transferable or saleable.
• Additional terms specific to each program or offer may be imposed.

Users may submit ratings and reviews after using the services. All reviews must be:

• Genuine
• Objective
• Not misleading
• Free from abuse or statutory violations

The Platform has the right to remove or modify any content that violates these Terms without prior notice to the User.

All content on the Platform, including designs, texts, software, logos, images, and databases, is the exclusive property of the "Comfy" Platform. No part of such content may be copied, modified, or reused without prior written consent.

The Platform is committed to protecting Users' data and processing it in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and in line with the Platform's approved Privacy Policy.

The User expressly agrees that the Platform may collect, process, store, use, and share the data necessary to provide the services and operate the Platform, including operational data, geolocation data, trip data, payment data, and communication data, where appropriate and for operational, security, statutory, or service-improvement purposes related to the services.

The User also agrees to the sharing of necessary data with suppliers, service providers, or competent authorities whenever this is necessary to implement the service, comply with statutory requirements, protect rights, or handle complaints and disputes, within the limits permitted by applicable regulations.

All data collection and processing operations are subject to the Platform's Privacy Policy and the relevant regulations. Use of the Platform shall constitute the User's express consent to the Privacy Policy and the data-processing mechanisms approved by the Platform.

To the maximum extent permitted by applicable law:

• The Platform does not warrant that the services, electronic systems, or payment methods will be free from interruptions, technical failures, or delays beyond its control.
• The Platform shall not be liable for the quality, safety, legality, or suitability of the services provided by rental companies, as they are independent entities responsible for providing the services subject to the booking.
• The Platform shall not be liable for any indirect, consequential, incidental, or special losses, or any lost profits, loss of data, or business opportunities resulting from the use of the Platform or services or the inability to use them.
• The Platform shall also not bear any liability arising from supplier delay, cancellation of the service, vehicle breakdown, or any operational failure occurring by the supplier or any third party.
• The Platform shall not bear any responsibility for disputes between the rental company and the client arising from their service provided to implement the booking and any subsequent matters, such as financial disputes involving claims and collection, accidents and their consequences, etc.; such matters shall be handled directly with the rental company itself, as it is an independent entity responsible for providing the services subject to the booking.

In all cases, and to the extent not contrary to the applicable regulations, the Platform's total liability, if any, shall be limited to the value of the service fees it received for the transaction subject to the dispute, without exceeding such amount for any damages, claims, or compensation of any kind.

The User agrees to indemnify and hold harmless the Platform, its affiliates, employees, and representatives from any claims, lawsuits, damages, losses, costs, or fees, including reasonable legal fees, whenever arising directly or indirectly from:

• The User's violation of these Terms and Conditions or any applicable laws or instructions.
• Misuse of the Platform or services or use thereof in an unlawful or fraudulent manner.
• Infringement of third-party rights or causing any damage to the Platform, rental companies, other users, or any third party.
• Any use of the vehicle or services in violation of the contract, regulations, or approved instructions.

The Platform shall not bear any liability for delay or failure resulting from circumstances beyond its control, including natural disasters, government decisions, network outages, wars, and general technical failures.

The Platform reserves the right to amend these Terms and Conditions at any time. The User's continued use of the Platform after the amendments are published shall be deemed implicit acceptance thereof.

This Agreement shall be governed by the laws of the Kingdom of Saudi Arabia. The courts of the Kingdom of Saudi Arabia shall have exclusive jurisdiction to hear any dispute arising from the use of the Platform or the interpretation of this Agreement, and the parties may agree to settle disputes amicably or through arbitration in accordance with the applicable regulations.

The Platform has the right, at any time and at its sole discretion, to terminate, suspend, or restrict the User's use of the Platform or services, close the account, or cancel any future bookings, without being required to state reasons, where permitted by applicable law, while taking into account the settlement of any existing financial rights or obligations prior to the termination date.
